Introduction
Welcome to Xtromate! These Terms and Conditions ("Terms") govern your use of the Xtromate website and mobile application (collectively, the "Platform"), operated by Xtromate ("we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
Platform Services
Xtromate provides a platform connecting users seeking local home repair and maintenance services ("Users") with independent third-party service providers ("Vendors"). Xtromate acts as an intermediary and does not provide the services itself.
User Responsibilities
- Account Accuracy: You agree to provide accurate, current, and complete information during registration and booking processes. You are responsible for maintaining the confidentiality of your account credentials.
- Service Booking: When booking a service, you agree to provide accurate details about the required service and your location.
- Payment: You agree to pay for the services booked through the Platform according to the displayed pricing and payment terms. Payments are processed securely through our designated payment gateway.
- Conduct: You agree to treat Vendors respectfully and provide a safe working environment if services are performed at your location.
- Platform Policies: You agree to comply with all applicable Platform policies, including the Privacy Policy and any specific service guidelines.
- Ratings and Reviews: You agree to provide honest and fair feedback on Vendors after service completion.
Vendor Responsibilities
- Verification: Vendors must provide accurate information and required documentation (identity proof, certifications, bank details) for verification.
- Service Quality: Vendors agree to perform services professionally, competently, and in accordance with industry standards and User requirements.
- Branded T-Shirts: Vendors agree to wear Xtromate-branded T-shirts (provided or approved by Xtromate) while performing services booked through the Platform. Compliance is mandatory.
- Cancellation Policy: Vendors must adhere to the Platform's cancellation policy. Frequent or suspicious cancellations may result in penalties or suspension from the Platform.
- Communication: Vendors agree to communicate promptly and professionally with Users and Xtromate support.
- Pricing: Vendors understand that service pricing is determined by the Platform, and commissions will be deducted from payouts.
Payment Terms
- Escrow: User payments are held in escrow by Xtromate or its payment processor upon booking confirmation.
- Release of Funds: Funds are released to the Vendor upon successful completion of the service, minus Xtromate's commission and any applicable taxes or fees. Completion is typically confirmed by the User or based on Platform criteria.
- Commission: Vendors agree to pay a commission to Xtromate for each completed job facilitated through the Platform. The commission rate will be communicated during onboarding or updated via Platform notifications.
- No Upfront Fees: Vendors are not charged upfront fees to join or list services on the Platform.
- Refunds: Refund policies are handled according to the Platform's dispute resolution process.
Dispute Resolution
- In case of disputes between Users and Vendors regarding service quality, completion, or other issues, Users or Vendors should contact Xtromate support at xtromateofficial@gmail.com.
- Xtromate will facilitate communication and attempt to mediate a resolution based on the information provided by both parties and Platform policies.
- Xtromate's decision in dispute resolution, including potential adjustments to payments or refunds, is final.
Intellectual Property
The Platform and its original content, features, and functionality are owned by Xtromate and are protected by copyright, trademark, and other intellectual property laws.
Limitation of Liability
- Xtromate acts solely as a platform connecting Users and Vendors. We do not guarantee the quality, safety, or legality of services provided by Vendors.
- Xtromate is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform or services provided by Vendors, including property damage or personal injury, to the fullest extent permitted by law.
- Users engage Vendors at their own risk. While Xtromate performs vendor verification, we do not endorse or guarantee any Vendor's work.
Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction, e.g., India], without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
